
New Delhi, March 24 Ten requests from central investigating agencies to prosecute officials are pending with the Union Home Ministry for more than three months, Lok Sabha was informed on Tuesday.
In a written reply, Minister of State for Home Affairs Nityanand Rai also said that since 2014, the ministry has granted 330 sanctions to prosecute officials.
"However, one such sanction has been rejected," he said.
"According to records, till February 28, 2026, 10 sanctions to prosecute officials, received from central investigating agencies, are pending with this Ministry for more than three months," the minister said.
According to the amended Prevention of Corruption Act, Section 19 mandates that the appropriate government or any competent authority has to convey the decision on the request seeking sanction to prosecute an official within three months, which may be extended by one more month.
The Bharatiya Nagarik Suraksha Sanhita also provides for a 120-day limit for the competent authority to decide on the sanction for prosecution requests.
In case of no decision within the period, the BNSS allows filing of chargesheets and courts to take cognizance of the offence against the public servant on the premise that sanction is deemed to have been given by the government.
