Thane, March 31 The Motor Accident Claims Tribunal (MACT) in Thane, Maharashtra, has awarded a compensation of Rs 21.19 lakh to the family of a 36-year-old man who was killed when he was crushed by a concrete mixer at a construction site in Mumbai in 2016.

Tribunal member R V Mohite directed the owner of the ready-mix concrete (RMC) mixer vehicle and the insurer, Universal Sompo General Insurance Co. Ltd., to pay the compensation jointly and severally, with 9 per cent interest per annum from the date of the petition.

A copy of the order dated March 23 was made available on Monday.

The victim, Ghanshyam Lalta Prasad Yadav, was working at a construction site near Bhoiwada on August 21, 2016, when the driver of the RMC suddenly started the vehicle without warning, crushing him.

The insurance company contested the claim, alleging breaches of policy terms regarding the driver's license and vehicle fitness. However, the tribunal rejected these arguments, noting that the insurer failed to provide any evidence to prove these claims.

"The driver, without a lookout or warning, started the offending concrete mixer and crushed the deceased... This shows his rashness and negligence," the judge said.

The final award of Rs 21.19 lakh includes compensation for loss of future income and prospects, loss of consortium, funeral expenses, and loss of estate.
