Prayagraj, February 27 The Allahabad High Court has granted bail to a man who was arrested last May for allegedly posting "Pakistan Zindabad" on his Instagram account after the Pahalgam attack.

Justice Arun Kumar Singh Deshwal passed the order on Faizan's bail plea and restrained him from posting any objectionable content on the internet.

"The applicant will not upload any objectionable post on social media that is against the reputation of the country or against any community," the court said.

It also warned him that any violation of these conditions would result in the cancellation of his bail.

Faizan was arrested by the Etah police last year under various provisions of the Bharatiya Nyaya Sanhita (BNS), including the offence of sedition.

During the court proceedings, his lawyer argued that although his post may have been objectionable, it did not violate Section 152 of the BNS, as he had not posted anything derogatory or disrespectful to India.

"Simply supporting an enemy country will not itself fall under Section 152 of the BNS," the lawyer said.

It was further submitted that Faizan has been in jail since May 3, 2025, and if granted bail, he would not misuse his freedom.

However, the state counsel opposed the bail petition, arguing that the offence was serious.

Considering the nature of the offence, the evidence, the involvement of the accused, and the overcrowded jails and heavy pendency of criminal cases before the trial courts, the high court granted bail to Faizan.

"Let the applicant, Faizan, involved in the aforementioned crime, be released on bail, on his furnishing a personal bond and two sureties each in the amount determined by the court," the court ordered.
