
Mumbai, March 18 – A court here granted pre-arrest bail to two executives of a construction firm and a project consultant in connection with the collapse of a parapet segment at a Mumbai Metro construction site in Mulund, which resulted in a fatality last month.
Alpesh Patel (Managing Partner) and Ganesh Gholap (Technical Director) of Milan Road Buildtech LLP, along with project consultant T Sai Suresh Kumar, had sought anticipatory bail, fearing arrest in the case. They claimed they had no direct involvement in the work on site and were falsely implicated.
Additional Sessions Judge M Oza granted their pleas.
A portion of a concrete parapet collapsed at a Metro construction site in Mulund on February 14, resulting in one death and three serious injuries.
The police have registered a case for alleged culpable homicide not amounting to murder, mischief causing damage, and other relevant offenses under the Bharatiya Nyaya Sanhita (BNS).
The anticipatory bail applications, filed through advocate Suvarna Vast, claimed that the site supervisor had specifically instructed the welder not to touch the hooks of the un-concretized precast parapet. However, the welder allegedly ignored these instructions, causing the collapse, and subsequently fled the scene.
The company stated that its project director and other senior staff immediately rushed to the site to assist the victims and cooperated with the police investigation.
The police, opposing the applications, alleged that the two individuals were responsible for ensuring safety measures at the site.
