
Kathmandu, March 15 The Supreme Court on Sunday rejected an interim order against the Election Commission's decision to disqualify RSP leader Kishori Sah from contesting the recently concluded general elections in Nepal.
The court's refusal to issue the interim order also means that Nepali Communist Party (NCP) leader Matrika Yadav won the March 5 election from Dhanusha 1 constituency in the Madhesh province.
Sah, the candidate for the Rastriya Swatantra Party (RSP) in the election for the House of Representatives, had filed a writ petition in the Supreme Court demanding that the Election Commission disqualify his candidacy.
Sah's candidacy was cancelled because his name was included in a financial blacklist prepared by the Election Commission.
Although the RSP candidate received the highest number of votes during the parliamentary elections, a division bench of Justices Binod Sharma and Megharaj Pokharel on Sunday refused to issue the order he sought.
This upheld the Election Commission's decision to disqualify Sah's candidacy, and Matrika Yadav, the leader of the Nepali Communist Party, emerged victorious.
The NCP won eight seats through direct elections, and with nine more seats through proportional representation, the party secured the fourth position with 17 seats in the 275-member Lower House.
The RSP received 182 seats, but fell short of securing a two-thirds majority.
