Thane MACT Rules Insurance Company to Pay Compensation in Fatal West Bengal Accident

Thane MACT Rules Insurance Company to Pay Compensation in Fatal West Bengal Accident.webp

Thane, March 15 The Motor Accident Claims Tribunal (MACT) in Thane has awarded compensation of Rs 24.33 lakh to the family of a man who died in a road accident in West Bengal in 2018.

In his order of March 11, details of which were made available on Sunday, MACT member KP Shrikhande asked the owner of the offending vehicle, based in Assam, and the insurance company to pay the amount to the deceased Chandrabhan Danbahadur Singh's wife, two minor children, and mother, along with 9 per cent interest from April 7, 2022.

Singh (41 at the time) was standing along the road in the Purba Medinipur district of the eastern state on December 20, 2018, when a motor tanker crushed him to death.

Citing the chargesheet filed by Bhabanipur police in WB, the MACT rejected the insurance company's claim that Singh was negligent.

It is established in law that once a chargesheet has been filed and the driver has been found negligent, no further evidence is required to prove that the bus was being negligently driven by the bus driver, the MACT order said.

There is nothing in the records to suggest that the deceased Chandrabhan Singh was negligent or that he contributed to the accident, it added.
