TSP Reservation Dispute: Gurjar Sangathan Seeks Equal Opportunity

TSP Reservation Dispute: Gurjar Sangathan Seeks Equal Opportunity.webp

Jaipur, March 16 Gurjar Aarakshan Sangharsh Samiti president Vijay Bainsla has written to Rajasthan Chief Minister Bhajanlal Sharma to raise the issue of implementing reservations for Other Backward Classes (OBCs), Most Backward Classes (MBCs), and Economically Weaker Section (EWS) in the tribal-dominated Tribal Sub-Plan (TSP) areas of the state.

In his letter on Sunday, Bainsla termed the absence of reservation benefits for OBC, MBC, and EWS categories in the TSP region as "unconstitutional" and demanded corrective measures.

The TSP region includes parts of Banswara, Dungarpur, Pratapgarh, Sirohi, and Udaipur districts. Bainsla said that lakhs of young people belonging to MBC, OBC, and EWS categories residing in these areas are deprived of reservation benefits in government jobs and educational institutions.

Under the current reservation policy in the TSP areas, Scheduled Tribes (STs) receive 45 per cent reservation, and Scheduled Castes (SCs) receive five per cent, while the remaining 50 per cent seats are unreserved.

In contrast, MBCs receive five per cent reservation, along with OBCs, SCs, STs, and EWS, in the non-TSP areas of Rajasthan.

"This disparity exists solely based on birth or residence in the TSP region," Bainsla said, and alleged that it violates Articles 15(1), 16(1), and 16(2) of the Constitution.

"The Constitution of India does not give the state the right to discriminate against citizens on a regional basis," he said, citing provisions that guarantee equal opportunity for all citizens in matters of public employment and prohibit disqualification on grounds such as religion, caste, sex, descent, or residence.

Bainsla urged the chief minister to issue directions for the immediate implementation of reservations for MBCs, OBCs, and EWS in all recruitments and admissions in the TSP areas.
