Assembly polls: Delhi HC says no to plea against AAP minister nomination

New Delhi, Feb 3 (PTI) – The Delhi High Court on Monday declined to hear a plea challenging the nomination of Aam Aadmi Party (AAP) candidate and Delhi minister Mukesh Kumar Ahlawat for the upcoming assembly elections on February 5.

Justice Subramonium Prasad ruled that the petition was not maintainable, questioning its legal standing. "How is this petition even maintainable in law? Either you challenge his previous election on whatever grounds… this is not maintainable," the court stated. Following the court’s remarks, the petitioner opted to withdraw the plea.

The petitioner, a resident of Sultan Puri, alleged that Ahlawat had concealed crucial details while contesting previous elections. He claimed that the AAP leader, during the 2013 elections, filed an affidavit before the Election Commission but failed to disclose information regarding criminal cases against him. The plea further accused Ahlawat of withholding details about his income, assets, and family, including the number of his children and wives.

Seeking action, the petitioner urged the court to direct authorities to withhold pensionary and other benefits granted to Ahlawat as an MLA from Sultan Pur Majra and as a Delhi government minister.

However, the Election Commission’s counsel opposed the plea, deeming it premature since the elections are yet to take place.

The case stands dismissed following the withdrawal of the petition.
