Chennai, Feb 4 (PTI) – The Madras High Court has laid out stringent measures to ensure humane transportation of cattle, emphasizing space requirements, veterinary certification, and proper handling during long journeys.
Justice M. Nirmal Kumar issued the directive while dismissing petitions from Abbas Manthiri and two others challenging a Judicial Magistrate’s decision in Chengalpattu. The petitioners had sought interim custody of 117 cattle, which were rescued from illegal and inhumane transport conditions. The cattle, allegedly being taken to Kerala for slaughter, were found in distressing conditions and have since been relocated to goshalas.
Violation of Animal Welfare Laws
The judge noted that the rescued cattle were transported from Andhra Pradesh to Kerala in container lorries without basic necessities such as food, water, and adequate space. A veterinary report confirmed that the cattle were subjected to extreme cruelty, including being kept in unhygienic conditions with chilli flakes sprinkled and chillies placed in their eyes to keep them awake.Justice Kumar highlighted violations of the Prevention of Cruelty to Animals Act and the Transport of Animal Rules, 1978. As per these regulations, no goods vehicle should carry more than six cattle, and transporters must obtain a valid certificate from a qualified veterinary surgeon affirming the animals’ fitness for travel. Each consignment must also bear labels indicating the consignor and consignee details—none of which were followed in this case.

The judge emphasized the importance of adhering to animal welfare norms during transportation, including:- Space & Comfort: Cattle must be provided with enough room to stand, lie down, and turn around.
- Proper Handling: Loading and unloading should be done carefully to prevent stress or injury, using ramps and slip-resistant surfaces.
- Ventilation & Temperature Control: Proper airflow and temperature maintenance are crucial during transport.
- Food & Water: For long-distance travel, cattle must be given adequate food and water at designated intervals.
- Health Monitoring: Transporters should monitor cattle for signs of distress, injury, or illness, removing and treating affected animals immediately.
- Sanitary Measures: Vehicles must be cleaned before transportation to prevent disease transmission.
- Legal Compliance: Transporters must carry proper documentation, including veterinary certificates specifying the permissible distance and duration of travel.
The ruling reinforces the need for strict compliance with animal welfare laws and sets a precedent for humane livestock transport in the country.
