NEET-PG 2024: SC asks Centre, others to respond on plea for fresh counselling

New Delhi, Feb 4 (PTI) – The Supreme Court on Tuesday directed the Centre, the National Medical Commission (NMC), and other relevant authorities to respond to a petition seeking a fresh counselling process for the All India Quota (AIQ) Round 3 of NEET-PG 2024.

A bench consisting of Justices B R Gavai and K Vinod Chandran issued a notice to the concerned parties, scheduling the next hearing for February 7.

The petition, filed by advocate Tanvi Dubey, raises concerns about the timing of the AIQ Round 3 counselling, which, according to the petitioners, began before the conclusion of Round 2 counselling in certain states. The petitioners, all eligible for NEET-PG 2024 counselling, contend that this overlap in counselling schedules caused a significant issue for candidates.

The petitioners claim that several candidates who were initially ineligible for AIQ Round 3 were able to register and block seats in the AIQ. This situation arose when state Round 2 counselling was still open, allowing candidates to choose between the AIQ seat they had blocked and a potentially better seat in their respective state’s counselling.

The plea argues that this created an unfair advantage for candidates from states like Madhya Pradesh, where state Round 2 counselling had not yet concluded when AIQ Round 3 began. This led to blocked seats in the AIQ, which were not available for other eligible candidates, including the petitioners, to secure.

The petition further states that if AIQ Round 3 had been conducted after the completion of state Round 2 counselling, candidates would not have had the opportunity to block seats and then relinquish them later if they found a better option through state counselling.

The petition alleges that the actions of the Medical Counselling Committee (MCC) in conducting AIQ Round 3 before the completion of state Round 2 were inconsistent with the NEET-PG counselling schedule set by the Supreme Court. The petitioners argue that this practice deprived them of their rightful opportunities, which they say is a violation of their fundamental rights under Articles 14 (Right to Equality) and 21 (Right to Life) of the Indian Constitution.

In light of these concerns, the petition seeks the cancellation of AIQ Round 3 counselling and a fresh round to be conducted, taking into account the irregularities in the process. Alternatively, the petition requests the court to direct the MCC to conduct a fourth round of counselling for seats that were blocked by candidates from states where Round 2 had not concluded. The petition also suggests offering an opportunity for candidates to register for a stray round of NEET-PG 2024 counselling.

The matter will be heard again on February 7.
