Apex Court Orders Compensation, Upholds Citizens' Right to Shelter
The Supreme Court on Tuesday sharply criticized the Uttar Pradesh government and the Prayagraj Development Authority, terming their recent demolition of homes as "inhuman and illegal". A bench comprising Justices Abhay S Oka and Ujjal Bhuyan expressed strong displeasure, stating the demolitions had been carried out in an excessively "high-handed" manner, undermining the fundamental rights of citizens.
Violation of Fundamental Rights and Rule of Law
Highlighting the severity of the matter, the apex court bench remarked, "This shocks our conscience. There is something called the right to shelter and due process of law." Emphasizing the principle of rule of law, the Supreme Court underscored that residential structures of citizens cannot be demolished arbitrarily.
The court has directed the Prayagraj Development Authority to pay a compensation of Rs 10 lakh each to the affected homeowners within six weeks, serving as a stern reminder against unlawful administrative actions.
Background of the Case
The matter reached the Supreme Court following a plea filed by advocate Zulfiqar Haider, Professor Ali Ahmed, and several other affected residents whose houses were demolished. The petitioners argued that the demolitions were erroneously conducted under the presumption that the land belonged to gangster-turned-politician Atiq Ahmed, who was killed in a police encounter in 2023.
Previously, the Allahabad High Court had rejected their plea challenging the demolitions. Notices regarding certain constructions at Lukerganj in Prayagraj were reportedly issued to the petitioners on March 6, 2021.
Earlier too, the Supreme Court had criticized the Uttar Pradesh government for failing to adhere to legal procedures, indicating that such demolitions sent a "shocking and wrong signal" to the public.

With the latest directive, the Supreme Court has firmly reinforced the fundamental rights of citizens, particularly their right to shelter and protection against arbitrary administrative action. This ruling serves as a cautionary reminder to authorities across the nation about the importance of adhering strictly to due legal processes.
The Prayagraj Development Authority is now mandated to comply with the court's directive and compensate the victims promptly, highlighting the judiciary's continued role in safeguarding human rights and dignity.
