Virtual Courts Enhance Accessibility but Pose Fair Trial Concerns: Former CJI DY Chandrachud

Mumbai, Feb 27 – Former Chief Justice of India, DY Chandrachud, emphasized the need for a balanced approach between judicial innovation and integrity, stating that while virtual courts enhance accessibility, they also raise concerns about fair trials and data security.

Speaking at a conference organized by Welingkar Institute of Management, Chandrachud highlighted how artificial intelligence (AI) is revolutionizing case management by making legal processes more efficient. However, he cautioned against its overreliance, citing recent incidents where AI-generated fake case citations led to legal sanctions. “Machines can assist, but they cannot replace human judgment,” he asserted.

The former CJI stressed that as digital advancements redefine governance, the legal framework must evolve to remain fair, flexible, and future-ready. “Efficiency means nothing without fairness, accountability, and trust,” he said.

The Role of Affirmative Action and Digital Challenges

Addressing structural barriers faced by marginalized communities, Chandrachud reiterated the importance of affirmative action in education, employment, and leadership roles. “For true progress, we must ensure that everyone has the support needed to compete on a level playing field,” he stated.

On the risks associated with emerging technologies, he warned that cyber fraud has become a highly organized industry, leveraging sophisticated tools for human trafficking and financial exploitation. He also raised concerns about quantum computing’s ability to crack encryption techniques, potentially compromising critical government and financial data.

Legal Frameworks for AI and Cybersecurity

Chandrachud underscored the need for clear regulations to ensure AI accountability and robust cybersecurity laws to combat digital fraud. “Without a proactive and ethical legal framework, we risk a technological arms race where a few nations and corporations control global power,” he cautioned.

The rise of digital currencies and blockchain technology has further complicated the legal landscape, making governance more challenging. “We need a smart legal framework that protects users without stifling innovation,” he opined.

Global Challenges and Future Readiness

Discussing geopolitical and economic uncertainties, Chandrachud noted that global stability is being tested by issues such as climate change, regional conflicts, and economic fluctuations. “The world is in a state of flux, with nations turning inward and conflicts escalating in regions like Palestine, Ukraine, and the Congo,” he remarked.

Despite these challenges, he expressed hope that technological advancements could be harnessed for the greater good while ensuring strong legal safeguards. “As a global community, we must balance technological progress with ethical governance to safeguard our future,” he concluded.
